1 Acceptance of Terms
By navigating this website, requesting quotes, communicating with our risk advisory personnel, submitting inquiries, or accessing the Daris Client Self-Service Portal, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service and our Privacy Policy.
If you do not agree with any portion of these terms, you should discontinue use of this website and our digital self-service tools immediately.
2 Agency Regulatory Status
Daris Insurance Agency is a licensed insurance agency established in Kenya and regulated under the Insurance Act (Cap 487, Laws of Kenya) by the Insurance Regulatory Authority (IRA).
As an insurance intermediary, our statutory responsibility is to connect clients with reputable, authorized insurance underwriters, provide professional advisory, assist in the procurement of insurance covers, and facilitate client policy administration and claims guidance.
3 Nature of Advisory & Agency Services
Information displayed on this website regarding various insurance packages—including Motor Vehicle Insurance, Medical/Health Insurance, Child Education Plans, Life Assurance, Property Insurance, and Commercial/SME Solutions—is provided for educational and advisory guidance purposes only.
While we strive to ensure that all information on cover options, benefits, limits, and deductible structures is accurate and up-to-date, the specific terms, exclusions, warranties, and conditions of any insurance cover are defined exclusively by the respective insurer's signed proposal form and policy schedule.
4 Quotes, Cover Notes & Premium Estimations
Any instant insurance estimate or premium quotation generated through our website inquiry forms or digital channels constitutes an invitation to treat and does not represent a final, binding contract of insurance.
- Quotations are calculated based on the preliminary details provided by you (such as vehicle valuation, age of vehicle, driver history, cover type, or medical disclosure).
- Final premium rates, acceptance of risk, and binding cover are subject to formal underwriting review, documentation verification (such as logbooks and inspection reports), and underwriter confirmation.
- Temporary cover notes and digital certificates become valid and enforceable only upon payment of the agreed premium according to the Cash-and-Carry provisions of the Insurance Act.
5 Duty of Utmost Good Faith (Uberrima Fides)
Insurance contracts in the Republic of Kenya are founded upon the fundamental legal doctrine of Utmost Good Faith (Uberrima Fides).
You are under a strict legal duty to disclose fully, truthfully, and accurately all material facts concerning the subject matter of insurance. A material fact is any fact or circumstance that would influence the judgment of a prudent underwriter in assessing risk or determining the applicable premium.
- Failure to disclose material information, deliberate misrepresentation, or providing false vehicle or health declarations may entitle the insurer to void the insurance contract ab initio or repudiate claims.
- Daris Insurance Agency shall not be held liable for any loss, claim denial, or policy invalidation arising from false, inaccurate, or omitted client information.
6 Premium Payments & Cash-and-Carry Rule
Under Section 156 of the Insurance Act (Cap 487), insurance coverage in Kenya operates under the statutory "Cash-and-Carry" requirement. An insurer or insurance intermediary is prohibited from assuming risk or issuing binding cover until premium has been remitted or guaranteed as specified by statute.
- Premiums must be remitted strictly via our verified corporate payment channels (official Daris Insurance Agency paybills, designated bank accounts, or underwriter-direct payment portals).
- Always ensure you receive and preserve an official Daris Insurance Agency receipt or electronic payment transaction reference.
- We do not accept personal cash payments to unauthorized third parties.
7 Digital Motor Certificates (DMVIC)
All motor vehicle insurance certificates issued through Daris Insurance Agency are processed through the statutory Digital Motor Vehicle Insurance Certificate (DMVIC) system under the supervision of the IRA and the Association of Kenya Insurers (AKI).
- Digital certificates carry a unique cryptographic QR code and authentication serial verifiable by law enforcement and statutory inspectors.
- Unauthorized alteration, duplication, or tampering with digital certificates is a criminal offence under Kenyan law.
8 Client Self-Service Portal Rules & Security
Clients who register for the Daris Client Self-Service Portal agree to use the platform responsibly:
